Direct negotiation and mediation are arguably universally accepted as the most effective dispute resolution process. But when they are not successful and there is a choice between resolving disputes using arbitration or litigation, opinions differ. Factors such as jurisdiction, project type and complexity, time, expenses, and the need to join other parties are some of the factors that design professionals should considered before contractually binding.
